Kim Zolciak Says Judge Got It Wrong, Court Hearing Incomplete

The custody battle between‘Real Housewives of Atlanta’alum Kim Zolciak and her estranged husband Kroy Biermann just got messier. Just weeks after losing custody of their four children, Kim is fighting back in court—and she’s challenging the legitimacy of the entire hearing that led to the decision.

In court filings obtained by TMZ, Kim argues the custody ruling shouldn’t have happened at all. Her beef? A family therapist refused to show up and testify despite being under subpoena, and she wasn’t given a fair chance to cross-examine the witnesses who did appear, including the court-ordered lawyer representing the kids. Without those voices in the room, Kim claims she couldn’t properly expose what she sees as Kroy’s false allegations or challenge the lawyer’s recommendations.

Here’s what kicked this off: back in April, Kroy claimed Kim was neglecting their children and described her as“both unstable and unfit.”He argued she was“more selfishly concerned with her own image and her work options than with the opinions of experts and/or the best interest of the children.”Those accusations led to an emergency custody order in May that gave Kroy sole custody of all four kids—a decision that clearly blindsided Kim.

Now she’s asking the court to throw out that emergency order entirely, arguing the process was fundamentally flawed. Kim’s legal team previously dismissed Kroy’s motion as“unwarranted,”but the court apparently didn’t see it that way—at least not the first time around. Whether the judge agrees that the hearing was incomplete enough to warrant a do-over remains to be seen, but this custody war is far from settled.
